The Investigation and Commencement of Repair (Scotland) Regulations 2026 apply through the Right to Repair Scheme and Repairing Standard.
Accommodation within the Scottish Right to Repair Scheme or Repairing Standard: social tenancies and much of the private rented sector, with statutory exclusions.
Coverage depends on the tenancy and legislative route. The guidance separately discusses temporary accommodation and Gypsy/Traveller sites. Check the official scope rather than assuming every occupancy agreement is included.
Read each trigger and the full official qualifications. A working-day investigation, repair commencement and repair completion are different requirements.
A competent person investigates within 10 working days of awareness.
Summary to the tenant or representative within 3 working days after investigation concludes.
Commence repair work within 5 working days after the investigation concludes.
Complete within a maximum of 20 working days from repair commencement.
Complete as soon as reasonably practicable; no equivalent blanket 20-working-day maximum.
The Scottish provisions require notification, reasons, a revised timeframe and reasonable interim steps where compliance is prevented by circumstances beyond the landlord’s control.
For a problem now, use existing repairs and complaints routes; do not wait for commencement. Under the new regime, Scottish Government guidance explains the social Right to Repair route and the private-tenancy Housing and Property Chamber route.
Future dates are scheduled or intended unless the official source confirms commencement.
6 October commencement; any corrected guidance; implementation and tenant communications.
Scottish Government guidance explains the separate investigation and repair requirements for landlords in Scotland.
